General terms and conditions of business General Terms and Conditions (GTC) of Marys Farbklecks Scope of Application: These GTC apply to all contracts, deliveries, and other services between Marys Farbklecks and our customers. We do not recognize any deviating terms and conditions of the customer unless we have expressly agreed to their validity in writing.
Conclusion of Contract: The contract is concluded upon the customer's order and our confirmation. The presentation of our products on the website does not constitute a legally binding offer, but rather an invitation to place an order.
Prices and Payment: All prices are quoted in euros and include statutory VAT. Payment may be made via advance payment, PayPal, or credit card. The purchase price is due upon conclusion of the contract.
Delivery: Delivery is made to the address specified by the customer. Delivery time estimates are non-binding, unless a specific delivery date has been expressly guaranteed.
Right of withdrawal: Customers who are consumers within the meaning of Section 13 of the German Civil Code (BGB) are entitled to a right of withdrawal in accordance with statutory provisions. Details regarding this can be found in our instructions on the right of withdrawal. Exception for custom-made items: The right of withdrawal does not apply if the artwork was created according to the customer's individual specifications.
Retention of Title: The goods remain our property until full payment has been made.
Warranty: Statutory warranty rights apply. In the event of defects in the delivered goods, the customer is initially entitled to supplementary performance. If this fails, the customer may reduce the purchase price or withdraw from the contract.
Liability: We shall be liable for damages not arising from the delivered item itself—regardless of the legal grounds—only in cases of willful misconduct, gross negligence, or the breach of essential contractual obligations.
Data Protection: We collect and process personal data only in accordance with statutory provisions. Further information can be found in our privacy policy.
Final Provisions: The law of the Federal Republic of Germany applies, excluding the UN Sales Convention (CISG). The place of jurisdiction for all disputes arising from contractual relationships is our place of business, provided the customer is a merchant.
